    Default High Court ruling this morning on latest Sean Quinn alleged naughtiness

    Sean's expected to be in the room today as a ruling on his alleged contempt of court is due. Basically the court ordered that Quinn Group not take any action to move assets out of the jurisdiction, and the Irish Bank Resolution Corporation are alleging that Quinn as well as his son and nephew have been doing just that, shunting assets to Russia and Ukraine.

    The Quinns admitted that they had attempted to put assets beyond the reach of the bank.

    However they claimed any steps they took were taken before the High Court made the orders.

    Ms Justice Elizabeth Dunne has indicated that she will rule on whether or not there was contempt of court before hearing arguments about what action should be taken.
    The grey area seems to be what happens if you've already initiated the move prior to the ruling that you had to stop, but then gave instruction continuing the move after that point.

    Aside from the risk of prison/fines if found guilty, it would probably see stronger restrictions on what the Quinn's can and can't do with their assets.

    If the court rules today that the Quinns breached the court's injunction and they're found to be in contempt of court immediate and indefinite imprisonment should be the first option of the judge until they purge their contempt by returning those property assets they've admitted to placing beyond the reach of the IRBC and as a warning to others who might be considering taking similar actions, at this stage financial penalties would be completely ineffective.

    Yes I never understood how releases could be made without the contempt being purged. A few nights of tea and biscuits in the clanger would be water off a ducks back to anyone trying to make a clean get away with a billion or two.

    I'm conflicted here. Clearly this ************************ and his brood deserves a few months inside, but what good will that do? He's already hidden all his vast assets while subjecting us to his debts, so incarcerating him will do no good, and he'll need 24/7 protection from the ODCs with whom he should share a cell.

    There are a couple of other cases where other banks/Nama are following the same route to pursue assets but the courts are not inundated - are the commercial costs of doing so outweighing the benefits? (Despite the sound bites from politicians).
