    Default Two jailed for online hate posts

    Two neo-nazis have been jailed in Britain for posting messages on their neo-Nazi web forum which incited violence against Jews.

    Michael Heaton, 42, of Leigh, Greater Manchester, and Trevor Hannington, 58, from Hirwaun, described Jews as "scum" and encouraged people to kill them.
    The self-proclaimed neo-Nazis were both cleared of soliciting murder. Heaton was convicted of stirring up racial hatred - a charge Hannington admitted.
    Heaton was jailed for 30 months and Hannington for two years.

    Justice Irwin told Heaton his words were of the most "insulting and extreme nature" marked by "violent racism" and said only a significant jail term was acceptable.

    Two questions - if the incitement to murder charges were dropped, should they have been jailed for 'stirring up racial hatred'? And what is the law here in Ireland, is encouraging murder in web posts a similarly-punished offence?

    It may well be under the Non Fatal Offences Against the Person Act

    Mmmmm technically it's possible but I am aware of only one prosecution since 1998. It's a rather nebulous offence and incredibly difficult to prove.

    What about racial hate posts? I'm not sure my freedom of speech sensibilities extend as far as racialist hatred. Appeasing the devil and all that. What about encouraging the shooting of a visiting head of state (which I saw here the other day)? Is that a criminal offence, I wonder?

    Someone posted a photo of the inside of Ivor the Eejit's holiday home. There should be a statute against crimes of appalling taste, he could serve the sentence for diddling his expenses concurrently.

    My question is why do muslims get away with screaming from the rooftops right under the nose of policemen in alot of cases the same type of hatred speech and inciting violence?

    Incitement to murder and kill is wrong. However the issue of what is hate speech is different. For example many liberals here have called me and other 'bigots' and our language 'hate speech' for opposing gay marriage. Despite the fact that President Obama and former Australian Labour PM Kevin Rudd both opposed it too. So who will define what constitutes hate speech?

    Your freedom of speech counts for little in Ireland as the constitution qualifies it as being subject to "public order and morality".

    The law prohibits inciting hatred against a group of persons on account of their race, colour, nationality, religion, ethnic or national origins, membership of the travelling community or sexual orientation.

    So posting a racial comment which would be threatening, abusive or insulting and would be intended to be or, having regard to all the circumstances, would be likely to stir up hatred would be an offence.
