    Incidentally, too TDs criticised Mahon today for choosing the body's legal reps. A FF TD described the Chairman of a Tribunal's right to select their Senior Counsel as "cronyism".

    Look at it another way would you pay a guy who obstructed you from going about your lawful business ?

    They really do not give a fup as long as it is delay after delay the hope is Biffo/Lenny will find a reason to close it down.

    Mahon fails to overturn Lawlor legal costs ruling - The Irish Times - Fri, Nov 26, 2010



    This wretched woman and her son appeal to the SC and get to walk away from 2 judgments attached to their property on a technicality.

    The money is owed to the State, 430k, run up by Liam Lawlor which he kept putting on the never never all the time hoping Mahon would be stopped or FF would get him off the hook.

    Do hope the powers that be at Nama are watching this case and can advise the Govt to adjust the Law to take into account this loophole as many of their debtors could use same.

    Can only hope lands surrounding the property can be sold and the widow's house left intact but the lovely Hazel wont go for that, she is part of the FF entitled, the SC decision is lawful but sickening nonetheless.

    "Mr Justice Joseph Finnegan, with whom Mrs Justice Susan Denham and Mr Justice Donal O’Donnell agreed, delivered the court’s judgment and observed it was “to be regretted” that the recent Land and Conveyancing Law Reform Act 2009, which made significant changes to the relevant law, had not been of more assistance.

    It would be of assistance to the courts and to those advising judgment creditors and judgment debtors if the 2009 Act gave guidance concerning the basis for, and circumstances in which, the courts would exercise a discretion provided for under the new law. ......

    Section 117 of the Act, which deals with the effect of registration of a judgment mortgage, “does not make any clearer” the basis upon which the courts should exercise that discretion, the judge said.

    It was “to be regretted” the opportunity presented by the 2009 Act for clarifying fully the reliefs and remedies available to a judgment creditor for the benefit of both the judgment creditor and judgment debtor was not availed of by the legislature, he added."



    My heartiest congratulations to our dynamic, tree-climbing, blasphemy-hating Minister for Justice, Dermo Ahern who skilfully steered this flawed legislation through the Oireachtas. He has served his Party well although his fellow citizens less well. This SC verdict confirms that he is worthy to lead the Soldiers of Destiny.

    One can only hope a new Govt will put this wrong to right, no way does Lawlor's family deserve to gain financially from Liamo's ill gotten gains, Judgments are 8 and 6 years old.
