    Sean Gallagher suing the frontline

    FORMER presidential candidate Sean Gallagher has brought a High Court action against RTE claiming a "Frontline" debate was unfair and damaged his electoral chances.


    The court heard today RTE has agreed to file a defence to the action by June 17 next when the case will be mentioned again.


    Mr Gallagher is seeking a declaration that the October 24, 2011, Frontline debate was "unfair" and allegedly "seriously damaged his electoral prospects."

    looks like the bagman has tumbled onto his latest money spinning wheeze

    in my opinion, it would set a very bad precedent if he won, politicians being able to sue the media for percieved misrepresentation if they think it affected their electoral chances

    The bagman strikes back! Further proof he was unfit to be president of anything.

    Nothing percieved about it ....no truck for gallagher but if it stops RTE being the official media carrier of the Labour party line and forces it to face up to its stickie past and current huge Labour bias ( kennys discussion on cpa2 today involved Impact and begg!!, no alternative viewpoint allowed) then bring it on ....might lead to a few fresh faces in its current affairs dept too

    The Broadcasting Authority did find against R.T.E. so their defence is weakened straight away. How much are R.T.E. willing to pay to make this go away? I can see the ghost of the Father Reynolds case coming back to haunt R.T.E.
    Whatever about Gallagher R.T.E. do need to get a hammering and as one poster says maybe the door will open for some new talent. There are many fine young journalist graduates who should be given a chance

    The fake tweet undoubtedly decided the election. Therefore this suit is necessary to defend democracy from conspiracy to pervert the course of the democratic process. A number of audience members were reportedly linked to Labour. SG was questioned more than the other candidates, which violates the Constitutional right (Article 40) to equal treatment, as did the fact that alone amongst the candidates, he was the only one the other candidates were allowed to question. The fact the ads were presenting the show as a "gamechanger" also raises questions as to whether that in fact was the motivation behind the unequal treatment.

    We also need to track down the source of the original tweet and act accordingly. A new offence of "conspiracy to pervert the democratic process" should be created to punish knowingly fake tweets/stories designed to influence elections. The fact the story came out so close to the broadcast blackout was especially invidious given it deprived him of time to expose the falsehood of the allegations.
