    Lisbon treaty text by Article: Article 3 TFEU (exclusive competences)

    Article 3 TFEU defines the areas where ONLY the EU may act, and where national governments of member-state of the EU are prohibited from acting.

    Article 3 of the renamed treaty (it was previously only the Treaty on the European Community) also extends the ability of the EU to agree international treaties into the wider range of policy areas under Lisbon where the EU has law-making power and not simply on common market issues as before.

    Article 3 (exclusive competences)
    1. The Union shall have exclusive competence in the following areas:
    (a) customs union;
    (b) the establishing of the competition rules necessary for the functioning of the internal market;
    (c) monetary policy for the Member States whose currency is the euro;
    (d) the conservation of marine biological resources under the common fisheries policy;
    (e) common commercial policy.

    2. The Union shall also have exclusive competence for the conclusion of an international agreement when its conclusion is provided for in a legislative act of the Union or is necessary to enable the Union to exercise its internal competence, or in so far as its conclusion may affect common rules or alter their scope.

    My perception of this article is as such: Please correct me if I'm wrong.

    This means we no longer have any national say on what can/cannot be imported into our own soil? Our land borders are essentially dissolved and our customs officers toothless.

    (b) the establishing of the competition rules necessary for the functioning of the internal market;

    This would mean the end of our low corporate taxation rate.


    (c) monetary policy for the Member States whose currency is the euro;

    How does this change from where we are with the ECB at the moment?


    (d) the conservation of marine biological resources under the common fisheries policy;

    Does this mean that our fishing industry will be put to death for good?

    (e) common commercial policy.
    This could mean anything....
