    getting maintenance from an ex!

    hi has anybody had as much trouble as me trying to get your ex to pay for their child?
    my child is 7, to date i have recieved 50euro from him.
    I have been to family court over the past 7 years, i am waiting the last 3 years for the gardai to act on a bench warrent fro my ex for non payment and then non show in court, they do not take this serious at all and i have gave up trying to get them to arrest him, mean while i have recieved 50 euro to date and cannot go back to court till the bench warrant is acted on.
    has anybody have a similar experience?

    Is he involved with the child or is he excluded? Did he exclude himself? If he is not involved with the child he shouldn't pay.

    How do you figure that out? In Ireland access is not linked to maintenace. If he is the father he should pay regardless of whether he has or has not access.

    What an extraordinary attitude!

    I didn't realise there was an opt-out clause from parenthood?

    As for the OP, I know of a few in similar situations but I leave it to those with legal expertise to respond.

    So he shouldn't pay but the taxpayer should? At least he got a rattle out of it? What do I get?

    Imo that's far to black & white an attitude to take, but there is an issue there. Along with rights comes responsibility, in these cases along with responsibility maybe there should be some rights.

    You and the child's father seem to have split up around the time of his/her birth, has he acknowledged that he is the child's father and is he listed as the father on the birth certificate?

    I never cease to be astonished at how little effort our lawmakers have made to deal with matters that are not difficult at all to look after.

    This is how child maintenance is taken care of in several of our EU partner countries.'

    1. If the father does not cough up his maintenance money, it is paid to the mother by the State. Regularly and on time.

    2. The father now owes the State money and the State gets it from him one way or another. It can attach his earnings, seize property if he has any and, if he is a really recalcitrant type, stick him in a labour camp.

    Why not do the same in Ireland? Mindy should be getting her money and be able to spend her time looking after the child, whilst the State has plenty of resources to go after the dad. If it can put people in jail for not paying a TV licence fee ...:mrgreen::mrgreen:

    I suppose the lesson here is not to have kids with a total loser.
