    McDowell breached children's rights - court

    The Minister for Justice has unlawfully breached the rights of several Irish-born children in the way he refused their non-national parents leave to remain in the State, the High Court has found. Judgments in eight separate test cases today are expected to lead to hundreds of such cases being reconsidered by the State. The decision relates only to non-national parents of children born before January 1st, 2005. - Ireland.com Breaking News

    I hope McDowell appeals this to the Supreme Court.

    They can appeal it to the kangaroo court again it does not carry any weight given the gravity of the judgement which the european union
    Representative were present at the court ruling,but isnt it time for the
    Present government to look back and check themself as to why the
    Problem of non-national citizen children still persist up till today :

    But my own asumption is that we need to do things right all the time,but
    Do not think about the parent countries than the citizen childrens right as
    An irish/european citizen.

    Another mockery lapses in the law was that before a non-national children
    Could obtain citizenship is when one of the parent has resided legally for
    Three years before the birth of the child well agreed :!:

    My questions to the minister of citizenship is that,among the people you
    Granted residency to last year after you wasted their time for two and half
    Years before you got a kick by the revised residency has another CHILD
    again before the three years, what nationality would that child be :
    Minister of citizenship we need an answer or you're trying to control when
    They should have a child and when they should not have,because in any
    Well organised society any immigrant that has residency to remain,the
    Child they born has the citizenship right authomatically.

    Because i believed you can not deprived the middle child and give the one
    After the three years it will be unconstitunal on equal basis given the
    Parent legal residency right. so we need an answer citizen minister :


    Or they have to apply for naturalisation after they have been born in
    Ireland and they have irish brothers or sisters that're born here aswell
    With passport and their parent has legal right please i dont understand

    Does this mean that hundreds of foreign women will now return to Ireland each with a gaggle of kids in tow - to be followed some months later by the 'fathers'?

    Maybe I'm reading this wrong but did I not read that this judgement has implication for 'hundreds' of cases. As each case must include at least one child, one mother and one father that could be quite a lot of people!

    If Bertie simply 'must have' a Referendum between now and the next GE I suggest he gets Michael to draft something to stop this Farce going any further - it will be a sure fire winner with the Irish voters anyway!

    Hey seeing as the PC Brigade are always going on about of the 'Rights' this group or that group how about inserting a clause in the Constitution upholding the Rights of Irish people in Ireland?

    Or aren't we supposed to have any specific Rights?

    The decision relates only to non-national parents of children born before January 1st, 2005.

    An estimated 1,120 people have had applications refused under the Irish-born child 2005 (IBC05) scheme, a revised arrangement for processing claims to remain here on the basis of having a child born here before January 1st, 2005, when citizenship arrangements were altered.

    The scheme was introduced by the Minister in early 2005 and, up to January last, some 16,693 people have been permitted leave to remain under it.

    Of those refused, most were refused on grounds that continuous residency here since the birth of the applicant's Irish-born child was not proven.

    This doesn't sound like a huge issue, it is ringfenced from 2005 onwards & seems like of the pre 2005 only 7% were refused anyhow.
