    Carroll gets temporary reprieve

    Looks like Zoe Group will get to present their petition. ACC calls it “extraordinary and unprecedented”. Fingers crossed it is kicked out and this squalid little group of people are crushed under the weight of the law.

    Zoe group wins. Ireland loses. Law a poor third.

    The High Court has granted permission for the hearing of a petition for court protection for seven companies in the Zoe development group while it puts a rescue plan in place.

    The decision by Mr Justice John Cooke in the High Court today means the petition will proceed to a full hearing where the court will decide whether to appoint an examiner to the companies in Liam Carroll’s beleaguered property group.

    The judge said Mr Carroll can file a new petition for examinership and there was a "clear imperative" to hear it.

    He deferred setting a date for the hearing and issuing his detailed reasons until Monday.

    Bizarre, are the courts in the tank for the Govt and the NAMA wrecking ball??

    The best description of the court scene I have read so far is by Sean MacCarthaigh in today's Examiner. He likens it to the Wild West.

    They granted the hearing on the basis that there is new evidence worthy of examination - the court has not granted examinership nor should it be assumed that they will do so. The application thus far has merely been an application for an application.

    The judge had regard for the fact that all the creditors bar ACC want an examiner appointed.

    that's all they (and the banks) need; to stagger on through September till Dail Eireann sells the country..
    Mr Gormley described calls for the resignation of his cabinet colleague as "absolute nonsense". He said Mr Lenihan was doing "a very good job under exceptionally difficult circumstances".

    Fair enough. But its not "new" evidence! Its evidence that Carroll did not furnish to the original hearing!

    I thought the SC had already ruled on this. How can it go back into a lower court ?
