Does not the ignoring of mandatory sentences laid down by law indicate that they have been doing this for years? The main blame in this affair of Mr.A rests with the over-imaginative interpretation of the law by judges.I see where you're coming from - but you have to remember that the Courts are subject to the law, and (strictly speaking) should be guided by nothing else.
Many people have complained that the striking down of this law is an example of Judicial Activism at its height. But would it not be an even more grave, and even sinister, act of judicial activism if the Supreme Court was to ignore the law in the way that you suggest and to follow its own senses of morality?
