FT you have left out the point you make 99.9% of the time and that is if we endorse Lisbon the charter of fundamental rights will provide a prima facie case for appealing deportations to the ECJ. While the ECJ might ultimately turn down the appeal the case would take years to be processed meaning years of financial burden and also providing a basis for the "asylum seeker" arguing they are knitted into the community.
