    Constitutional Protection - Where is the AG?

    The current government has now tried two different ways to ride roughshod over the constitution.

    Firstly John Gormley wanted to ignore the inviobility of the dwelling (Art40.5) to turn off house alarms.

    Now Biffo wants to "caution" an artist for a bad taste painting and was trying to force TodayFM to give his name? Surely this is against Art 40.6 (freedom of speech)?

    Constitutional rights can be shelved in extreme cases, e.g. to prevent a greater crime, e.g. if a house is on fire you can break in to save someone's life or if someone is advocating murder you can limit their speech. Neither of these cases comes close.

    So now the question is "Where is the Attorney General, the protector of the consitution?"

    The AG is a government appointee and a member of the cabinet so dont expect much there.

    Yes but according to Art 30.3 he cannot be a member of the govt. He is also legal advisor to the govt. Surely he should say it's a non starter.

    Is the OP actually familiar with much Irish history from recent decades? If so, I presume his/her question is rhetorical.

    Asking 'Where is the Attorney General' is rather like asking 'Where was the Financial Regulator?'

    The answer in both cases is: 'Standing right there, doing absolutely nothing, as per instructions.'

    So now the question is "Where is the Attorney General, the protector of the consitution?"

    I can’t say, but I can categorically tell that where exactly where he wasn’t on the weekend of 5-8 June 2008.

    He wasn’t, I repeat wasn't, attending the 2008 Bilderberg Group Conference in Chantilly, Virginia, USA, that’s for sure!
    The prime reason why he wasn't there is because it never really happens at all and anybody who believes it does, necessarily believes in aliens being still alive in Area 51 and all that other lizard men New World Order nonsense.
    So there you are, now you all just go back to sleep and don’t do any more research, sure you won’t, that's strictly for those lizard men ha ha ha idiots and you're much much smarter than them aren't you all.

    Have constitutional law exam tomorrow and was secretly hoping someone would give me an insight to get me an extra few marks.

    AG is non political so no point stirring it up, can't win an election seat from him.
