    I'm not sure that's what Kelly is at at all, in fact I'd say he's perhaps being played (deliberately or otherwise) by parties involved in the process.

    Indeed he was missing when McCabe came calling looking for justice although he wasn't alone on that front.

    You don't understand the process. "The Commission" - which means the Member, or Members - is not attacking anyone. It is listening to evidence from witnesses and and cross-examination of those witnesses.

    Btw Emily, did you read any of transcripts of the testimony of Keith Harrison and his partner at the Charleton Tribunal? He was shredded, utterly exposed...which is why the papers said very little about it, I suppose.

    At a meeting with McCabe in Mullingar in August 2008 Supt Noel Cunningham and Sgt Yvonne Martin both made false and malicious statements against McCabe. These were proved to be false when McCabe provided a recording of the meeting. They withdrew their statements to Higgins after this. Such affidavits are legal documents and lying is akin to perjury.

    No action has been taken against these two perjurers.

    You really don't see a problem with that?

    Even if McCabe's allegations against the state had been untrue, the state isn't an equal, entitled to react in the same way. It runs all the institutions necessary to prove its good faith in the first place.

    And since you know McCabe's allegations were pretty much on the ball, you're justifying the state apparatus being used to crush an individual in a way that would be acceptable only in tyrannies like Soviet Russia. Not that it doesn't happen elsewhere, but not many citizens would be stupid enough to defend it.
    You misundertand the process - a Commission of Investigation or a Tribunal is an independent body - like a Court - set up to investigate something.

    The Guards and McCabe (and other witnesses) are in the same position as regards a Commission or Tribunal - they give evidence to the Commission/Tribunal, are cross-examined by Counsel for other witnesses and in the end the Members of the Commission or Tribunal decide what the truth of it is, in their view.

    The idea that McCabe Counsel's should be able to attack the credibility, motives and integrity of Garda witnesses at a Commission/Tribunal, but Counsel for the Guards should treat McCabe with kid gloves, is ridiculous.

    Whether this is correct or not, again, it has nothing to do with the point of this thread, which is about the so-called strategy to discredit McCabe at the O'Higgins' Commission.

    Okay...so whether or not you think Fitzgerald is a sleazy scumbag for endorsing a hatchet job on McCabe is only part of the problem.

    Why do you think she lied about it ever since then and do you think a Minister for Justice should lie about what she did and didn't know about such a contentious topic?
