    Children's Rights Referendum

    I have a few questions:

    A: Is a referendum on this even necessary or could the intended affect be acheived through Oireachtas legislation anyway?

    B: Should the poll be held on the same day as Lisbon.

    C: Should the referendum on Children's Rights completely abolish the defence of "honest mistake" or should it merely restrict it?

    D: Should the referendum go ahead in the absence of consensus between the 3 main parties?

    On (B), I would strongly support separating the age of consent matters from the rest of children's rights. I would oppose any amendment that would result in compulsory school attendance (struck down in 1943 as unconstitutional) - but I would support age of consent strictening.

    I don't think an honest mistake defense is necessary, because no one should have sex with a person they do not know rather well - well enough to be assured of age. Yes, this will mean "one night stands" will require IDs and therefore become way less popular - and well, it's a good thing!.

    So you feel that in a case where a suspect is 17, and the victim is 16, and where the victim lied about her age, that the 17 yr old should not be allowed to use this fact as a defence? Why not?

    A law like this could only mean all underage teenage fathers will be labelled as perverts by the authorities. A ludicrous idea.

    I don't see why this referendum is nessicary at all, are childrens rights being violated wholescale in Ireland?

    It is reasonable to make extensive checks befor indulgeing

    You cant go on a plane without ID, and it is reasonable to know who will make love to. Little delays like that do no real harm.

    You know well that some people are unusually tall. How do you tell whether a 6ft tall person is 16 or 18 if they claim to be 18?

    Having said that I agree that it shows the need for universally compulsory ID cards.

    You know well that some people are unusually tall. How do you tell whether a 6ft tall person is 16 or 18 if they claim to be 18?
    You date them for some months, get to know their family. THEN you have sex. What's unreasonable about this?

    This arrangement does nt require marriage and has no discrimination on sexual orientation.

    As a last resort if you MUST "indulge". show each other IDs first.

    Really and how do you go about verifying it? You're coming up to 19, you're in a nightclub that for over 18's only you met a girl she's drinking, you chat to her about this and that and charming devil that you are it's back to yours. Only the following morning you find out she wants you to come to celebrate her 17 birthday which is a week later.
