Therefor the prosecution could never prove that any physical altercation was the actual cause of death. In such circumstances the trial judge has no option but to direct the jury as he did. The states case basically collapsed when confronted by that defence. You are blaming the judge for the states failure to adequately prosecute their case.

You should add also that the injury to the brain was caused by a fall to the ground after a heart attack and the head striking a sharp object like a stone hearth. . That was the plausible explanation offered by the defence .

Its clear that Judge Roe should not have presided over this case. That imo was the greatest injustice and remains so to this day.

Fr Molloy was an Army chaplain and, after 5 years's service, would have been entitled to a gratuity: he was one week short of the 5 years when the Bishop of Elphin moved him elsewhere, a unprecedented action which lost him thousands. Why did he do this?

Fr Molloy's will was sent to the Elphin diocese for safekeeping after his death but was "mislaid".

Something smells there too.

Well you tell me then what was the immediate cause of Fr Niall Molloy,s death since your so smart.

When Fr Molloy went on overseas service he was required to make a will under army regulations. He was a priest of the Elphin diocese and was replaced by another priest in Athlone from the diocese of Elphin. The will was kept on file and when he left army service his will should have been returned to him personally.
The will format used in the Defence Forces is a shortened special will called a soldiers and sailors will AFAIK

You claim Molloy was due thousands in a gratuity after 5 years army service?

How many thousands?

Back up this with actual figures rather than wooly dubious assertions

Are you somehow insinuating the Bishop transferred Molloy to save the state having to pay out some gratuity?

Eoin, I had previous experience of this Field Marshal character on another thread and gave up any interchange with him as a bad job, a waste of time.There are a few posters beyond logic but,thankfully not many.
