    Justice

    What is justice in Ireland, we have a political system which is rotten to its core.We have Political Appointments to the Judiciary for the old boys network.Again like a lot of things in this state we need a complete overhaul from top to bottom., but I won't hold my breadth

    There is a very good poem by Auden about law. The poem makes clear the distinctions between law and justice. Justice is what evey society used to aspire to. Unfotunately, Ireland, being no more imaginative than our neighbors, can't come up with the proper imaginative distinctions anymore. What is more the pity is that we have the talented people to make these distinctions. Unfortunately, (again), money is getting in the way of our scholars.

    There is actually a relatively recent (last 5 yrs or so I think) board set up called the Judicial Appointments Advisory Board or something along them lines anyway who draw up a shortlist of 3 (I think 3 but I'm open to correction) which the Government must pick from.

    An absurd assertion. If you want to see a political system which is "rotten to its core", try Zimbabwe.

    Judge,

    The Judicial Appointments Advisory Board draws up a list of 7 names, in no order of preference, and submits same to the Cabinet. The Cabinet then picks one from this list of seven, though it can actually disregard the list should it so desire. To date all judicial appointments have been from the list of 7.

    In fact, McDowell, who I am no fan of, made certain, as Minister for Justice, that over his tenure we have had some excellent appointments, particularly in the High Court, and not on a political basis. I am thinking in particular of Frank Clarke and John McMenemin who are undoubted Fine Gael supporters yet, were appointed by the last Government to the High Court. Mind you, thanks to the soldiers of density, we also had some appalling appointments though overall much better than under other administrations. Discretion (and the fear of being sued) keep me from identfying the appalling ones!!
