    Gun Laws

    Is there anyone out there with a good understanding of the laws in this state on legally held firearms and specifically, someone who could answer the following questions:

    1. What material, in terms of identification etc. is needed by an
    individual applying for a gun licence for a shotgun?

    2. Is a person with a criminal record barred from obtaining a gun
    licence? Is a person with a specific kind of criminal record ie violent
    crime or crime committed with a firearm, barred from such a gun
    licence?

    3. Is a Garda background check necessary in order to obtain a gun
    licence and if so, what aspects of a person's background might prevent
    them obtaining such a licence?

    4. If an individual is refused a licence because of the judgement of a
    member of An Garda Siochána does that person have a right to know what that judgement is and the evidence for it?

    5. If a person who has previously held a licence applies to renew his
    or her licence what conditions must he or she satisfy in order to have
    the licence reviewed?

    6. In the case of an application to renew a firearms certificate is the
    conduct, either positive or negative, of the holder of the licence in
    regard to fulfilling the conditions under which a licence is issued
    taken into account?

    7. What, if any, appeal procedures exist for an individual refused such
    a licence, or whose renewal of such a licence is refused?

    That seems fairly clear. As far as I know, its totally illegal to have a handgun (unless you are in the Defence Forces or the Gardaí.

    According to Section 17 of the Firearms Act 1964 (afaik this is till in force), a licence can be refused to:

    (d) any person who has been sentenced by any court in the State to penal servitude or to imprisonment for any term which has not expired or has expired within five years previously for a crime in the course of which a firearm was used or a firearm or an imitation firearm was produced for the apparent purpose of intimidating any person or a threat to use a firearm against any person or property was made, and

    (e) any person who has been sentenced by any court in the State to penal servitude or to imprisonment for any term of not less than three months which has not expired or has expired within five years previously for a crime consisting of or including an assault on any person


    And to:

    ( f ) any person who is subject to the supervision of the police, and

    ( g ) any person who is bound by a recognizance to keep the peace or be of good behaviour, a condition of which is that such person shall not have in his possession, or use, or carry any firearm or ammunition.


    under S.8 (1) of the Firearms Act, 1925.


    Re:renewal, under S.9 (3) (b) of the 1964 Act:

    The power of renewal conferred by this subsection shall be subject to such reservations (if any) as may be specified in the authority of the Superintendent.

    According to S.4 of the Firearms Act 1925:

    4. —Before granting a firearm certificate to any person under this Act the superintendent of the Gárda Síochána or the Minister (as the case may require) shall be satisfied that such person—

    ( a ) has a good reason for requiring the firearm in respect of which the certificate is applied for, and

    ( b ) can be permitted to have in his possession, use, and carry a firearm or ammunition without danger to the public safety or to the peace, and

    ( c ) is not a person declared by this Act to be disentitled to hold a firearm certificate.

    5. —The superintendent of the Gárda Síochána of the district in which the holder of a firearm certificate resides may at any time revoke such certificate if he is satisfied that the holder of such certificate—

    ( a ) has no good reason for requiring the firearm to which the certificate relates, or

    ( b ) is a person who cannot, without danger to the public safety or to the peace, be permitted to have a firearm in his possession, or

    ( c ) is a person who is declared by this Act to be disentitled to hold a firearm certificate, or

    ( d ) where the firearm certificate limits the purposes for which the firearm to which it relates may be used, is using such firearm for purposes not authorised by the certificate.

    I think most of this is still valid law, but can't be entirely sure. Regarding some of your other questions, it seems the only good place to get an answer is your local Garda station, if they won't be too suspicious of a Shinner inquiring about the availability of firearms. :wink:
