I think the proposals to make it 16 is going too far. Idealy it should be 18, like most American States.

I think 16 is fine. At 16 most youngsters are intelligent enough to asses a situation.
Before the age is lowered however, the Irish education system needs to inroduce sex education that isn't just from a Religious and Biological perspective. The youth need educating on STD's, Contraception, etc.

What about the 18-year-old in the US who had sex with his 17-year-old girlfriend, completely consensual, and no suggestion of coercion at all. He was sentenced to a 10-year minimum mandatory sentence, publicly registered as a sex offender for life, and banned from living within one mile of a school, playground and a long list of other institutions that children use, covering almost half the area of his state.Originally Posted by Desigol1979
Actually I agree with 18, but it should be made a valid defence (onus of proof on the accused) that there was no coercion or inequality of power between the two parties, and if this is the case, then no offence has been committed. So if teacher has sex with 17-year-old pupil, teacher goes to jail, but if it's a classmate they don't.
Equally if 17-year-old has sex with 14-year-old girlfriend, then age difference constitutes an inequality of power.

Common sense should apply, something America's (or the UK's) justice system lacks.Originally Posted by GJG

I would favour 18 also. Playing around with the creation of life should be something for adults only.Originally Posted by Desigol1979
I wouldn't disagree with 18, but from a practical perspective 17 makes more sense. That is the age when most kids leave school (and the protection of parents etc.) and go to college.
They're doing it at 16, so there's no point in having the legal age of consent at 18 which neither reflects reality nor is implementable but between 16 and 18 there should be protection against anyone with a duty of care (teacher, social worker, doctor ,etc.) having sex with those who should be under their protection.

The legal age of consent does have an effect upon behaviour. It won't influence everyone, but it would discourage others.Originally Posted by Limerick Lad
I'm sorry, but what do you mean by this? There was a widespread review of the legislation relating to Sexual Offences in the UK only recently, in what areas do you feel it is lacking in common sense?Originally Posted by Desigol1979
They're also doing it at 14 and 15.Originally Posted by Limerick Lad
