An odd question. But since Victorian acts pre-date the Constitution they only have as much force as the latest legislation eg 1989 Judicial Separation Act, 1995 Family Law Act, 1996 Divorce Act and 2004 Civil Registration Act. As long is it is within the confines of the High Court decision in Zappone and Gilligan v Revenue (and the decision of the Supreme Court.
