    State turns its back on the rights of the unborn

    The high court has turned its back on the rights of the unborn by allowing a 17 year old girl travel abroad for an abortion:

    Under the Irish constitution, everyone has a right to live and the constitution is supposed to uphold that right.

    but under the constitition, doesn't everyone have a right to travel too ?

    Which right, both being protected under the Constitution gains precedence ?

    The right to life does...


    The Right to Life was recognised by the courts in re a Ward of court as pre-eminent over all other rights in Bunreacht na hÉireann,

    “It was submitted on behalf of the guardian ad litem and the Attorney General that it was for the court to decide all matters relating to a ward of court, not for the family or the carers, as by virtue of Article 40, s. 3, of the Constitution, the right to life was pre-eminent and all other fundamental rights must give way to it.”

    The definition of unborn
    Circumstances in which a fetus has no chance of survival
    Circumstances of rape or incest

    Just a handful of things not provided for either by law or by the constutition...no wonder this debate never ends...

    Well every child that is born will die at some stage. Should whether they will die 3 days or 3 years after after birth have an impact on their right to life or their mothers right to have an abortition? I'm not sure that aspect was actually crucial in this case.

    What was crucial was whether the HSE has the authority to prevent the girl traveling. If the girl was due to give birth to a perfectly healthy baby (not that we can ever be 100% sure of that) were the HSE then within their rights? I think we have to wait for the full judgment to emerge on this one.

    You know what I've anseerd this debate so many times I'm sick of it.

    I'll get into this debate again when our leaders have the balls to start answering those questions themselvesand actull legislate in this area.
