    Correct. Smoking whilst driving even if your children are in the car is not a form of delinquency however.

    Sobriety is required because drunken drivers are an obvious risk to their own and other people's safety. Not sure how the state can enforce 'concentration' in a driver (do we ban anyone from driving if they haven't had 8 hours sleep the night before?), and as for 'observance of societal norms', since when has smoking in a private space been considered abnormal?

    Good point, but the key difference there is that they all inhibit or aid safe driving.

    Yes.

    Since you are the one advocating a ban, the onus is on you to prove otherwise.

    A lot safer than eating a hamburger and chips or a breakfast roll with coffee while driving I'd say.
