    Obama to restart the Bush-era military tribunals for Guantánamo Bay detainees

    President Barack Obama is to restart the Bush-era military tribunals for Guantánamo Bay detainees that he once denounced.
    Mr Obama suspended the tribunals within hours of taking office in January, ordering a review but stopping short of abandoning President George W. Bush’s strategy of prosecuting suspected terrorists.
    On the presidential campaign trail in February 2008, Mr Obama had described the Guantánamo trials as “a flawed military commission system".

    Despite all the promises made during the campaign, the security policies of Obama are becoming virtually the same as his predecessor. From saturation bombing of areas of Pakistan to "military tribunals" at Guantánamo Bay, it is almost impossible to distinguish between Obama and GW Bush.

    Read the remainder of the article. There will be difference's between the bush version and the obama version.

    To say that Obama's security policy will be "almost impossible to distinguish" from Bush's is nonsense.
    Bush's was driven by ideology , Obama's is driven by pragmatism.
    The results may occasionally be the same, but that is not by design.

    It is understood that the changes to the tribunal system will include:
    * Restrictions on hearsay evidence that can be used in court against the detainees.
    * A ban on all evidence obtained through cruel, inhuman or degrading treatment. This would include statements given from detainees who were subjected to waterboarding.
    * Giving detainees greater leeway in choosing their own military counsel.
    * Protecting detainees who refuse to testify from legal sanctions or other court prejudices.

    I did. If you think that the above a significant you are gullible in the extreme. The military court will rule on whether "evidence" was garnered by the military using torture. Ha.

    A military trial is a military trial.

    I always wondered how Obama was going to live up to his words and sqaure them with reality with regards to Gitmo. Never for a minute thought he could. Everyone just pretended that the status of enemy combatents and all the meaning that that term is loaded with was no longer important, which was never the reality. The prospect of the US arresting terrorist suspects in other jurestictions and then trying them onto US soil is a thorny issue. In fact too thorny to make work unless in a civilian justice system unless the US was prepared to re-rig its entire justice system and constitution.

    No Critic of the US has ever come up with a workable alternative to Gitmo, that is the sad truth. A truth that Obama has come to realise. Why else has Chaney been so vocal of late?

    Charge the ones you have evidence against in a real court giving them a fair trial and legal representation. If they are found guilty, give them an appropriate sentence. If they are found not guilty, release them.

    Release the ones against whom you do not have evidence or against whom the evidence is based wholly or in part on torture and is therefore irretrievably tainted.

    Oh ok. Obamas will give them a good cop bad cop routine. They'll be told they'll get a little coffee shop on Miami beach if they cooperate. Then they'll be waterboarded but only after they've been given the car battery to the testicles. Other way around with Bush.

    None of the internee's at Guantanamo are military prisoner's, as such, they should at the very least, have access to legal counsel and have their day in a civil court.

    The U.S media meme that everyone in Gitmo is a terrorist is disgraceful. Due process and innocent till proven guilty apparently are not things that the government need to be challenged on anymore.
