Is the death penalty still on the statute books in India?

Yes, but the Supreme Court has ruled that it is to be imposed in only "the rarest of rare cases". The Mumbai attack would probably fall into that category. The prosecutors certainly threw the book at Kasab, because the scores of charges against him included one of not having a platform ticket when he mowed down dozens of people at the Chhatrapati Shivaji Terminus.

We don't know the full story, but it looks like there was prior knowledge of the attack, and it seems likely that Hindu extremists tok the opportunity to eliminate Hemant Karkare, the head of the Mumbi Anti Terror Squad in order to put a stop to his investigation into Hindi sponsored terror which was blamed on Muslims:
