More conservative then Roberts. The problem, however, is that the Dems will allow Roberts through [to make themselves look constructive and bipartisan] but will then hold up his new appointe with a filibuster.
Not that it will change the makeup of the court, as he was a conservative. However, it will 'renew' this conservative seat for another 3 decades.
Scalia for Chief Justice
Chief Justice, or just Justice? I read a report earlier that suggests he might consider putting Roberts forward as Chief Justice, and filling the remaining vacancy with someone else. I don't know how precedented something like that would be.Originally Posted by WyldeOne
I do think that he's in a pretty weakened state, politically, with falling approval ratings over Iraq, the disastrous handling of the hurricance aftermath and the possibility of serious problems arising in the next month from the investigation of the Valerie Palme leak. Because of this, I doubt if he'll try to nominate anything other than Roberts mark 2 (conservative, but nice enough not to scare the horses). Having said that, knowing my precognitive skills (not quite on a par with Danny's) he'll probably try to put Scalia forward.
At the risk of being insensitive, though, this death doesn't really matter that much in terms of the make-up of the court. Renquist was a conservative, and will be replaced by a conservative, thus the balance will remain the same. It's the Day-O'Connor retirement that's much more significant.

I was under the impression that the Court itself chose which of them would be the Chief Justice based on legnth on the court. This would keep a "newbie" from really screwing things up.
I agree with most of this. Bush isn't going to put forward another centrist, it should be a conservative, from his pov. I think part of the mystery surrounding the function of the court from the general pov of the public is what will truly make his death a massively significant event. There are a lot of arguments here about what the role of the Supreme Court is. Some think the role is to make laws, others to enforce laws. The role of the Court is to determine the Constitutionality of a law created by the legislative branch. Since most politicians are going to create their own spin on this, I think his death will be as interesting to watch as O'Connor's retirement.At the risk of being insensitive, though, this death doesn't really matter that much in terms of the make-up of the court. I was sorry to hear of the death of William Rehnquist following a battle with thyroid cancer. Known in private to be a modest man in a very high-profile position, he had a very long and distinguished career serving the US Supreme Court for more than 33 years. The pro-life movement will certainly remember him for voting against the establishment of legalised abortions in 1973. I hope God remembers him now.

Yes, and the civil rights movement will remember him for trying to keep blacks out of shops and restaurants in 1964.
