    We've had a case in the last 2 weeks in Galway of a 6 year girl too.

    I would note that the case in Australia involves males who were also under the age of consent which makes prosecutions more problematic.

    They are not all minors. One has a previous conviction for a rape of a child.

    How prosecuting scum like that on the basis that a ten year old girl allegedly gave her "consent" is problematic is a fkn mystery to me.

    I thinks it's the judges comments that are causing as much fuss as the actual sentences.

    An absolute Disgrace, people who rape minors should be locked up for a minimun of 15 years and in certain cases the death penalty is the only appropriate punishment. If I'm not mistaken the judge who passed sentence has resigned.

    Something weird appears to have happened with the prosecution of the case. The judge is saying that she accepted the sentences proposed by the state prosecutor, which is fairly common, I imagine. Certainly, judges would get into very dodgy territory if they started handing down sentences that were not supported by the evidence presented by the prosecution. So, if the judge is telling the truth (and it would be a fairly strange lie to tell), I think the prosecutor is going to have some explaining to do. It's possible that the prosecutor didn't think that s/he could secure any convictions at all, given the evidence available, so this may have been a case where a very lenient plea bargain was thought to be better than no conviction at all (and then the judge just screwed everything up by saying stupid things at sentencing).

    Liberal! As I have mentioned before, rape, of anyone, causes lifelong problems, effectivly a life sentence, this is what needs to be applied, I doubt though had this happened here the sentence would reflect on the damage done.
    Sentencing is supposed to protect the community, this needs to become more victim focused.

    Well after reading into the case a little further, I cant disagree. However, her comments seem to leave me with the view that she has a very strange sense of what is right and wrong?

    What about castration?

    With regard to the leniency of the sentences, I wonder if the following had any effect.

    The four juveniles are aged 14 to 16 years. They and the adults come from some of the most prominent and powerful Aboriginal families on Cape York... The child victim, now aged 12, does not enjoy the elevated family status of her attackers, and has had to be removed from Aurukun and put with foster parents.
