The case was admitted by Mr Justice Peter Kelly to the Commercial Court and proceedings are being brought against Ger Killally and Richard Connor, practising as Gerard Killally Auctioneers.
    The plaintiffs are seeking damages against them for alleged negligence, misrepresentation, breach of duty, breach of contract and are also seeking an inquiry for damages for the alleged unjust enrichment. One of the claims relates to the Daingean Road Partnership formed in 2005 between Mr Guing, Mr Lawlor and the defendants to acquire and deal in lands at Cappincur, Tullamore. It is claimed the partnership was to acquire those lands for €6.5m from another party and that the partnership was told this was the best price available.
    It is alleged that the defendants did not disclose they had an interest in the transaction and had concealed the true nature of the transaction.


    A series of secret transactions were procured by the defendants whereby the lands were first sold for €5m, leaving the defendants making a secret profit of €1.5m in relation to that transaction, it has been alleged.

    Typical FF, of course Brian "Cave-in" Cowen sees no evil, just like when his former boss ahern was stealing money from his party.

    Between this dude, and the tax-cheat brother who owns that complete dive of a pub in Clara, Mr. Cowen has some interesting pals in Offaly.

    Given the control that FF have over the county, I'd say that if the truth was known, it would make North Co. Dublin look tame in comparison

    Well there was that grubby affair about the mining shares that Cowen held while he was Minister for natural resources........... that nasty issue was conveniently air-brushed from the various hagiographies which were written about him earlier in the year

    I doubt that an honest man could even get off the bottom rung in FF. The only honest people I know in FF are foot soldiers in their late 50s who stood by through thick and thin and turned a blind eye to Dev and Haughey for what they perceived to be the greater good, opposing anything liberal which FG and Labour might have tried to bring in. Now even they are a little tired of FF.

    If FF had dumped ahern when it became clear what was going on they would not be in this fix now.
