    European Court of Justice rules against Ireland

    The European Union's top court has ruled that non-EU nationals married to EU citizens are entitled to live in their spouse's country.

    The court overruled a law in the Republic of Ireland, which grants residency only to those who have previously lived in an EU member state.

    The European Court of Justice had studied the cases of four non-EU nationals married to Irish citizens.

    It said the Irish refusal of residence permits contradicted an EU directive.

    "The right of a national of a non-member country who is a family member of a Union citizen to accompany or join that citizen cannot be made conditional on prior lawful residence in another member state," the ruling said....

    How many more Irish Laws, do we need see overruled, before Irish people wake up to the sham ,that is the EU.!!

    And yes, we should all live under the tyranny of stupid Irish laws, but because they are Irish it makes them ok.
    Ireland interests are best secured within a more dynamic EU. Vote YES to Lisbon.

    They may well be stupid laws but surely we should be able to make our own rather than them being dictated to us.

    They may well be stupid laws but surely we should be able to make our own rather than them being dictated to us.
    No, we pool our sovereignty and make laws jointly with the EU one the basis that transnational law making is on aggregate better for everyone, which of course means we get overruled from time to time.
    And lets not forget, this is a law we made specifically to do with EU residency, so what some here appear to be arguing is that we are a member of the EU, but make laws up on how the EU functions on a practical level for citizens of the EU, without recourse to those institutions. We're not a renegade country, we can't just make up stuff to suit ourselves when its an issue that concerns all other members, otherwise what is the whole point of joining such an institution.

    This is an excellent ruling. This was a very stupid law.

    I know a couple, an American and a French girl, who met here and married. The American was on a working visa and when they married he though - hey, I'll change to an EU Spouce visa and make my life a bit easier. It took 6 months to get a decision - No - and they also refused him permission to go back to the work permit.

    Now the couple live in exile in Northern Ireland, with the woman commutting to Dublin daily, and the guy working for his company's Belfast office.

    What is the point of such a law?

    A great judgement by the ECJ.

    As a eurosceptic I think this law was utterly ridiculous and I'm glad the ECJ has ruled as it did.
