Cross party concensus not required on next move re lisbon.

Heard Brian Lenihan on the radio saying cross party consensus wont be required on next move. As a rerun without labour would be very risky (central plank of every yes campaign is to smear no side as extreme right or left) i reckon what they are thinking of is a pact between FF & FG on parliamentary ratification.

But is it? Much legal opinion is 90-95% percent of it could be done this way.

Not after it has already been rejected by a referendum. Whatever merit that approach had, if any, prior to the referendum, it has none now. If Gilmore stays firm in his opposition I cannot not see FF&FG re-running Lisbon. Although I would not be particularly confident in Labour staying firm. FG would be mad to go down the legislative route giving FF political cover, but then again you can always rely on FG to take every opportunity to shoot themselves in the foot.

If it was referred to the SC, the Court would appraise the Bill on its consitutional merits, not on whether it was formerly put to the people in a referendum. If nothing else, it would clarify Crotty.

The Oireachtas acting without the unanimous approval of the Dail is unconstitutional?

That would make every piece of legislation on our Statute Book unconstitutional.

FG won't agree to that. The people have spoken.

Given the elitist reactions of FG figures to the no vote, I wouldn't put it past them, but FF might be more likely to rerun the vote with some figleaves on neutrality, abortion and tax instead.

And if such a referendum was passed, presumably you'd accept the people's verdict, and demand that the No side do the same?
"Elite - a small superior group; esp one that has a power out of proportion to its size." (Oxford English Dictionary)

The majority cannot therefore be the elite.
