No, I disagree with you there, H3. The litigation option does not per se empower a large state over a small state since the ECJ can only give a decision on the law. From my reading of the draft it will be the Commission which has the main function and ultimately power in enforcing the rule. The litigation option is a bit like an order of Mandamus remedy enforcing authorities to act when they have failed to perform a legal obligation, not a very commonly resorted to legal remedy.

How can it pass without a referndum? You can`t amend the fu*king constitution without a referndum, and since this agreement needs a constitution amendment, it needs a referndum. You have to be as thick as Noonan not to see that!
