    Has your estate escaped the household charge?

    On the household charge website, a list of estates exempt from the household charge have been listed. The list was drawn up last May between the Department and the local authorities . While many residents of these estates will welcome the exemption, for those where developers have been just pushing paper around those residents will be left to pay the charge. As a resident of one of those estates, where the developer turns up every six months to plant the 'odd' tree, I believe the collation of the list is a joke. The bloody Council can't even claim the bond on my estate because of legal complexities. Of course, it also begs the question, what if the developer has gone bust or disappeared since last May?

    The legislation provides that an owner of residential property which is situated in an unfinished estate, within the meaning contained in the Local Government (Household Charges) Act 2011, on the liability date (1st January) is entitled to a waiver from payment of the Household Charge in respect of that property for that year.

    A national survey of unfinished housing developments was carried out in 2011 by officials from the Department of the Environment, Community and Local Government, in conjunction with the Planning Departments of the various local authorities. As part of this survey, all unfinished developments were examined and categorised along the following lines:

    Category 1: the development is still being actively completed by the developer;
    Category 2: a receiver has been appointed;
    Category 3: a receiver has not been appointed and the developer is still in place but effectively inactive; and
    Category 4: the development has been effectively abandoned and is posing serious problems for residents.

    A person who, on 1 January 2012, is an owner of a residential property in an unfinished development contained in the prescribed list (estate categories 3 and 4 only) is entitled to a waiver from payment of the household charge in 2012.

    As I just posted on the 'pin, is there not so much as a single unfinished estate in South Dublin County Council?

    However, banks know they have a duty of care to their clients and I'm sure that this should prevent them lending irresponsibly.

    There are some nice (and not so nice) estates in Wexford that are on the list that were finished a decade ago.
    Clicking an ad a day keeps Politics.ie in business.

    No, sadly I will have to pay on the gate lodge, the boat house and the servants house. The main house has escaped for now, but for how long? They seem not to know about the hunting lodge and I transferred the Ski hut to the dog's name so all is well there!!!

    The only estate in my area that is exempt is an "exclusive" development of houses that were on the market for 800k (3 bed semi prices were sub 300k at the time).

    What criteria are used to exempt an estate as an unfinished Estate?

    Why is an Estate not exempt if it is not completed to such a standard as would allow the Local Authority to take it in charge?
