So if it does not fill half the incinerator and they have contracted to fill it, they have to pay for the balance or find it elsewhere. The Break Clause should be the perfect opportunity to get out of the contract. Is there any cost involved in the Break Clause or is it just the parties walking away?
Maybe i got this all wrong, if I did I am sorry; did DCC state (on RTE and elseware) that the contract was totally binding, and if Gormley stopped the project the taxpayer would be landed with a multi million euro compensation bill? The Primetime programme would suggest that such a claim was a tissue of lies...why would that be I wonder?
If there is a clause allowing DCC to walk away on Sunday then where would the issue of compensation arise?
And why was this clause never mentioned when DCC was warning that the taxpayer would face multimillion euro fines if the build did not go ahead?
Someone is being...flexible...with the information that they have been putting into the public domain in recent months.
Oh dear, please don't question the integrity of Dublin City Council. There are a number of posters on here that will assure you that DCC are only capable of acting in good faith, despite the fact that they're the only ones involved in this fiasco to actually have a High Court judgement against them for acting improperly.
