Could be a tricky one all right especially in the US where judges tend to be very political. However the Dover case was well handled by the Judge in question. The scientific evidence was carefully examined and the judgement arrived at seemed to be able to cut through creationist obscurement so maybe it is possible. Judge John E. Jones III was a conservative Republican appointed in 2002 by George W. Bush so that seems positive for the outcome of judicial process despite political background.

My overall impression is that the AGW theory is no longer viable -certainly it will never again obtain the kind of political traction it did pre-2005. The current alternative in terms of a credible (?) basis for global or quasi-global taxation is the War on Terror --so expect that to get all the emphasis going forward. What else is left? Certainly there's nothing else on the table that I can see.
As for investigations of Climategate and Climategate related matters, it could go on endlessly and probably will -but the strategy is not to rescue the AGW theory, but rather to wind it down -a lot of funding will need to be reassigned (gradually, as various parties vie for a cut) to other purported global matters, like the War on Terror.
