Thread: Article 27 & Referendum On Fiscal Pact

    Article 27

    This Article applies to any Bill, other than a Bill expressed to be a Bill containing a proposal for the amendment of this Constitution, which shall have been deemed, by virtue of Article 23 hereof, to have been passed by both Houses of the Oireachtas.
    1. A majority of the members of Seanad Éireann and not less than one-third of the members of Dáil Éireann may by a joint petition addressed to the President by them under this Article request the President to decline to sign and promulgate as a law any Bill to which this article applies on the ground that the Bill contains a proposal of such national importance that the will of the people thereon ought to be ascertained.


    I notice from this wording, that the 56 TDs and 31 Senators can REQUEST the President to decline to sign such a Bill. Does that mean the President has to accede to them or not?

    Thanks, by the look of that the President is not obliged to accede to any such request. He has to "consider" it, but that's all.

    See my original post in this thread for the link. Daly (on January 30th) calling on senator is the Seanad chamber to back an attempt at pushing Art. 27 (although the Examiner has a typo in the article and says article 21). Pringle made his press statement on February 1st, two days later. Martin subsequently confirmed Fianna Fáils support when he came out then and said this:

    I thought Daly merely proposed it..............if it was a serious effort to have a referendum which could scupper basic FF European policy surely Martin was the man to propose it?

    You do see the difference between calling for a course of action and initiating a defined strategy to bring such action about?
