    Publicans and After hours drink

    One of the first things the new Minister for Justice, whoever he or she is, should tackle is the problem with after hours drink.

    To me, publicans are getting away with allowing after hours drink being sold on their premises. The Gardai are not enforcing the licencing laws when they should do so.

    If I were Minister for Justice I would take a tough line with the Vintners Federation of Ireland. I would meet them face to face and tell them that the laws of the land are going to be implimented whether they like it or not.

    I would introduce heavy fines for breaches of the licencing laws. To me, publicans encourage people to stay on their premises after hours. Therefore, the publican should also pay the fines of what we call 'the found-ons'.

    I also think that the fines for after-hours drink need to be updated and brought kicking and screaming into the 21st century. It is an insult to read in my local newspaper that they are being fined a paltry €300-500 I would propose that publicans pay the equivalent of a night's takings, ie €20,000, which would hit them in the pocket, where it hurts.

    I would also bring in a three-tear penalty points system for persistent abusers.

    Firstly, they get the €20,000 fine plus they pay the fines of the found-ons.

    If they are caught again within the same year, they get an endorsement. Thirdly, they should be closed down.

    Publicans that allow drugs to be sold on their premises should also be tackled. I would close these down straight away.

    New Publicans who are entering the trade for the first time should pass a stringent test. This idea is radical. What I would propose is that they enter something like a good behaviour bond with the Gardai.

    They should be given a provisional licence for 18 months. If they come to the attention of the gardai once during that time, they forefit their licence.

    I also think that publicans condone drink driving. You never see an anti drink driving sign in a pub. I feel that the problem with road accidents and the tragedy on our roads is all drink related. How often have people been killed between the hours of midnight and four am. when they are returning home from pubs and nightclubs We hear it every weekend.

    The sooner the publicans do something about this the better.

    I would order all Garda Superintends and Chief Superintendents to stop attending Vintners Dress Dances in a professional capacity

    What problems exactly do these after hours drinks cause?

    I'm not talking about the legalities but rather the practicalities.

    the main problem is the road accidents. Reports say most road accidents occur between twelve midnight and four am. Most of the people that are killed and injured are usually killed by drink drivers.

    I was passing through Rathmore recently, at 1.20 am in the morning, to find the pubs in the town still open, people standing outside smoking, as if it was 11.30 am. It clearly sounds to me that the Guards are not enforcing the licence laws.

    The new Minister for Justice should issue a directive to the Garda Commissioner: Any Garda found colluding with publicans on the issue of after hours drink loses his job.

    Another directive could also be issued at the same time: Any Garda caught drink driving, on or off duty, loses his job.

    For instance what does "allowing drugs be sold on their premises mean"?
    Drugs are sold in pubs and clubs up and down ther country, 99% of the time without the knowledge of the owners.
    Secondly using drink-driving as an excuse to clamp down on after hours drinking is a red-herring. The problem with drink driving is drink driving, not after hours drinking.
    I think licensing hours should be extended.
