during the debate in the dail when they nationalised anglo, hours were spend by the oppositon demanding that a high court inspector be appointed to examine whats going on and to make sure everything is above board, FF did not want this, I think we now know why.
So, was Lenihan briefed about this when he took over in finance , and did Cowen know ? This is a very very very serious issue.
Is this why FF would not release the PWC report into the banks ? Is this why they did not let the oppostion see it when they requested it with any commercially sensitve information removed?
Its looking like Anglo was nothing more than a pyramid scheme. These things generally get nasty towards the end.
Hugely serious questions need to be asked - how much did the Minister know, when did he know it, and who did he tell?
A list of shareholder is a matter of record, isn't it? The relevant legislation that would enable such an appointment is Section 11 of the Companies(Amendment)Act 1990.
Considering the publicly stated attitude of Mr. Sean FitzPatrick to Company Law ,when he lead the corporate charge against the stringent proposals tabled in the Companies (Audit and Accounting) Bill 2003,it is hard to see what precludes such an appointment.
Corporate concerns arose over compliancy obligations for Directors.The Bill was spun off to the Company Law Review Group and accordingly amended to more 'business friendly' enactment.Speaking in 2003.FitzPatrick stated;
'we need to legislate to the necessary minimum,supplemented by codes of corporate governance and good business practice'
