    Report seeks constitutional change to allow civil unions

    A report prepared for the Irish Human Rights Commission has recommended constitutional changes to allow for so-called civil partnerships among both heterosexual and same-sex couples. The report says current Irish law in this area may be in breach of international human rights conventions by failing to recognise same-sex unions and by treating married couples differently to unmarried couples. - BreakingNews.ie

    I thought we only needed a constitutional change if they were gonna call ie marraige?

    Why would we need a constitutional change at all. When have the courts defined marriage as between a man and a woman. I know they've defined the family as being based on marriage, but if they haven't ruled on what the constitutional definition of marriage is, surely it's open to the legislature to do so?

    It can be done via legislation, but a constitutional change would solidify the rights of same-sex couples.

    I'm VERY uncomfortable with the idea of giving the majority a vote on the civil rights of a minority.

    I believe the last opinion poll showed a majority in favour of it for the first time.

    I suppose even if we eventually dump that archac relic of a constutition for a new one wed have to have a vote on it anyway.

    It is not open to the Oireachtas to legislate for same sex marriage. The final arbiter of the constitution is the Supreme who have ruled that marriage is between a man and a woman. Civil partnership would probably survive a constitutional challange but if it is to be marriage it would require a referendum

    The difffrence between the two is only the name tho isn't it?

    Depends on the legislation. So long as it would stand in the courts I really think such couples need to be given as many marital rights as possible. However it would be a great step backwards if it was implimented and then struck down as unconstitutional. I really don't think a referendum would pass it yet so a stepping stone approach might be the best option
