That was one of the first things that struck me. Surely, he and others involved in the dodgy movements of loans on and off books have a case to answer. On the other hand, this is Ireland where the electorate reward Ahern, Flynn, Lowry, Lawlor, etc.

If he gave a false certificate to external auditors, then couldn't he be done for this?

maybe he could be done for that, but moving the loans around is not a crime, its 'creative accounting'.

As much as I am disgusted by him and his behaviour, and that of many like him, I do not like mob justice, nor do I think it wise to comment on this topic, for any sanction that does come might well be deemed prejudiced (remember that the thief Haughey got away with it for far less). Perhaps lock?

If you were familar with company and accounting law and GAAP you would know this is'nt possible where fraud or dece[tion is involved.

My opinion? String him up. He and Anglo have ruined the reputation of our economy.

At the very least this should be investigated and if there is a reasonable chance of making charges stick ie Convictions, then the Law should take its course.

My worry is though that the Code of Financial Omerta will come into operation here and at the end of the day the culprits would walk out of a Court feeling 'Vindicated' as the case against them collapsed!

AIB, at the Tribunal, admitted to a similar trick to deceive their shareholders and the Companies Office. They transferred, in secret, a single share to their co-Directors in the Quarryvale development, against the express wishes of one of those Directors, in order to bring their shareholding down below 20% and thus noy have to declare it. Two days later, after New Year, they secretly transferred it back again. And they did this with advice from solicitors.
