Work Permit holders more privileged than E.U citizens?

In another instance of Ireland's guinness soaked politics gone awry, Irish Immigration laws give more privileges to third country Work permit holders than E.U citizens. An American known to me married to a Italian has been stuck without being able to work for a year even though a firm here sponsored her for a fast track 'Spousal work permit'. The Department of Trade which issues these permits to allow spouses of work permit holders to work denied her application and bizzarely asked her to apply for the more cumbersome work permit which entails a lengthy bureaucratic process.
They find themselves stuck in this situation because they moved her directly from the U.S and did not live in another E.U country first.
